Thursday, December 8, 2011 FDA Panelists Vote on Safety and Labeling of Yaz/Yasmin

Data suggests higher risk of blood clots in patients using Bayer’s Yaz and Yasmin when compared to older contraceptive pills according to Federal Health Experts.

The expert panel of the Food and Drug Administration voted 21-5 that Bayer’s current labeling on Yaz and Yasmin (drospirenone containing drugs) is “inadequate” and “needs more information” regarding the potential risk of blood clots in the legs and lungs.

Panelists discussed conflicting data for over 9 hours regarding blood clot risks of Yaz compared to other medications. The overwhelming majority of panelists said that because of the potentially fatal nature of blood clots, the drugs’ risks should be more clearly stated in the label.

“Clearly the wording is inadequate and incomplete,” said Dr. Richard Bockman of the New York Hospital for Special Surgery. He continued, “adverse events have to be made graphic, so physicians and patients are aware of the consequences.”

Mark Woods of the New York University School of Medicine states, “I can see no real group of patients that this drug benefited over the existing alternatives.”

According to the most recent study by the FDA, women taking Yaz and Yasmin had a 75 percent higher risk of suffering a blood clot when compared with patients taking a combination of older drugs. Although the absolute risk of a blood clot is still relatively low, even a slightly higher risk can be critical or fatal if the blood clot triggers a heart attack, stroke or blockage to the lungs or blood vessels.

Earlier in the day, panelists heard from patients and family members who blame Yaz and Yasmin for sometimes deadly blood clots. Cindy Ripee spoke of her last conversation with her 20 year old daughter Elizabeth. “My daughter was a very smart young woman. If Elizabeth had been clearly told that Yasmin had more risk, maybe twice as much risk as other pills, she never would have switched to Yasmin and would be here today.”

The Food and Drug administration has not set a timetable for any changes in Yaz’s labeling.

Recently, The New York Times cited a study that observed the outcomes of hip replacement surgeries over a five year period. It found that none of the modern, all-metal hip implants outlasted older versions and 30% were worse and caused more complications by comparison. The metal-on-metal ASR XL Acetabular hip replacement, manufactured by DePuy Orthopaedics, is believed to have a design flaw. This flaw has caused many patients to require hip revision surgery shortly after the placement of the implant.

The Times state that “the friction of metal parts – the ball and joint – rubbing against each other create splinters that can cause infection and other damage to the people who host these devices.” Estimations predict that the all-metal devices account for about 33% of the 250,000 hip implants that are put into patients on an annual basis. The Times estimate that 500,000 patients host the all-metal implants.

There are several manufacturers of these flawed devices, the two largest being DePuy Orthopaedics, (a division of Johnson & Johnson) and Zimmer Holdings. As of October 2011, DePuy division has recalled 40,000 of its all-metal implants. Already, 3,500 patients have filed suit against Johnson & Johnson. Meanwhile, the Times said that Zimmer Holdings claimed that “it’s all metal implants are safe,” and “hundreds of patient claims” were settled.

There is no tracking within the industry, nor by the US government to determine the frequency of hip replacement failures. However, it is estimated that the allegedly flawed all-metal hip replacements will cost their manufacturers millions of dollars in legal fees and settlement costs.

Emergency Room Visits and the Diabetes Drug Actos

Startling new information was recently reported by the New England Journal of Medicine. The Journal studied emergency room visits due to adverse drug events in older Americans. Mainly, what drugs were causing those 65 years old and older to make Emergency Room visits and become hospitalized. What they found was that most of these hospitalizations came from common, heavily-prescribed medications. These medications can be broken down into 4 categories: anti-platelet, blood thinners, insulin lowering and blood sugar lowering medications. These categories include popular drugs like Warfarin, Plavix and Actos. Both the insulin and blood lowering medications are typically prescribed for diabetics, indicating that diabetics are susceptible to adverse drug reactions. The study looked at close to 100,000 emergency hospitalizations that the researchers thought were largely preventable.

Takeda Seeks Approval of New Actos Combination Drug, Even as it Faces Actos Bladder Cancer Lawsuits

The pharmaceutical manufacturer, Takeda, is set to receive a decision from the Food and Drug Administration on January 25, 2011 regarding a new drug for diabetes therapy which combines alogliptin and Actos into a single tablet. In July 2011, Takeda re-filed an application to have the drug approved by the FDA and eventually have the drug made available to the public. The new data submitted to the FDA includes information about a cardiovascular outcomes trial. The new drug would be the first in the United States to have both a thiazolidinedione and a DPP-4 inhibitor in a single pill. Currently, Aloglitin is sold in other countries and has been approved by some regulators overseas.

However, the possible increased risk of bladder cancer from taking Actos for a year or more cannot be overlooked. In August 2011, the Food and Drug Administration approved updated labeling for Actos, a type 2 diabetes drug intended to regulate insulin and blood sugar levels in patients. The updated labeling indicates that the use of pioglitazone (Actos) for more than one year may be associated with an increased risk of bladder cancer. The Food and Drug Administration has recently announced a Class 1 recall for Avaira Toric Contact Lenses manufactured by CooperVision. A Class 1 recall is the most serious level of recall that the FDA issues. The contact lenses are used to correct nearsightedness or farsightedness in patients with astigmatism. According to the FDA, CooperVision sent out a recall notice to distributors and health care practitioners in August 2011 for approximately 778,301 lenses manufactured between November 2010 and August 2011. The FDA recommends consumers with the affected lenses return them to their eye care practitioner. In recent years, diabetics have struggled to find medication to regulate insulin levels. Two of the most prominent of diabetes drugs are Avandia and Actos. Actos may be sold under the generic name Pioglitazone and Avandia under the name Rosiglitazone. Osteoporosis drugs are intended to treat and prevent osteoporosis in patients by increasing the bone density and keeping the bones from breaking down, thus making a fracture less likely. These types of drugs usually belong to the Bisphosphonate category. Osteoporosis makes the bones more likely to fracture because the bones become brittle, often occurring in the elderly, making a fracture potentially life-threatening.

One of the most common Bisphosphonate drugs is called Alendronate, sold as Fosamax or a generic form. While many people who take Fosamax suffer only minor side effects, if any at all, others may have more severe problems. With all drugs, the benefits of taking Fosamax must be weighed against the potential harm that it could do. Patients need to assess and closely monitor their body for any reactions. Bladder cancer is a form of cancer that usually begins when cells that line the bladder develop tumorous growths. It is a common cancer, although there is little awareness of it, with close to 70,000 diagnoses and 15,000 deaths expected from it this year alone (1). Men are much more likely to develop the disease than women are. The cancerous cells begin to grow rapidly and spread to other parts of the bladder, forming a region of abnormal tumorous cells. These abnormal cells do not expand normally but instead expand rapidly and at much greater speed than normal cells. These tumors can overtake healthy cells because they block oxygen and inhibit their ability to receive the nutrients and material they need.
Bladder cancer cells can undergo Metastatis, meaning that the cancer spreads to other parts of the body than where it originated. In this case, bladder cancer often transfers from the bladder to the lymph nodes and kidneys before spreading to the blood stream where other vital organs, like the heart and lungs, are likely to be affected.

Like with most cancers, bladder cancer is diagnosed as being in one of five main stages. Stage 0 (pre-stage) is when the cancer is in the center of the bladder but has not yet reached the connective tissue or the muscle wall. Spreading has not yet begun. Stage 1 indicates that the cancer has reached the connective tissue but has not penetrated the muscle of the bladder wall. In Stage 2, the cancer has grown into the muscle layer of the bladder wall and the fatty tissue around the bladder. Stage 3 is characterized by cancer that has completely penetrated the fatty tissue of the bladder and possibly the surrounding organs, but has not yet made contact with the lymph nodes or areas that are farther away. In Stage 4, the cancer has either gone through the pelvic or abdominal wall, spread to the lymph nodes or reached a distant site such as the bones, liver or lungs.

Treatment options vary by stage. Surgery may be done to remove the cancer or tumor. This sometimes involves directly removing the cancer or removing the entire or part of the bladder and any affected lymph nodes and organs. Radiation is another common treatment method that involves using high energy x-rays to kill or contain the cancer cells. Chemotherapy uses powerful drugs to combat cancer, sometimes given throughout the body or directly applied to the bladder. Other approaches include strengthening the body’s natural immune system to help it fight the cancer off itself. A number of clinical trials are also being performed to develop new methods to combat this vicious disease.

Bladder Cancer Risk Factors

There is no one complete determination of what causes bladder cancer or what increases ones risk factors. It is, however, well established that cigarette smoking makes a person more likely to contract the disease. Smoking is a major risk factor for bladder cancer. New studies are finding that the diabetes drug Actos increases the risk of bladder cancer, specifically in those who have used it for more than a year. A similar drug, Avandia, has already been removed from the market after being linked to an increased risk of heart attacks. In fact, Actos and Avandia are the only two drugs in the class called thiazolidinediones, and work in very similar ways. Actos has already been removed from the market in Germany and France for these same concerns.

Actos is a drug used for patients who have type 2 diabetes. It is used to control the level of glucose in the blood stream when used with a healthy diet and exercise. It now carries a warning label for an increased cancer risk, but it remains on the market with the full support of the manufacturer. In 2010, more than 2 million patients were taking Actos. In one study done on the drug, out of 193,000 patients who were taking Actos for an average of 2 years, their risk of bladder cancer increased 40% compared to if they had never been exposed to the drug.

Zimmer Durom Cup Defective Hip Replacements

Zimmer Holdings Inc, the designer of Zimmer Durum Hip Replacement Cup has announced a recall of their product. Increase in Injuries with Medical Products

There has been much talk in the media about injuries from certain medical products. The two that have recently been problematic are the prescription drug Fosamax and certain DePuy hip replacements. Individuals must be aware of the impact that these medical products can have, both good and bad in order to make informed decisions. Recently, our firm has seen an increase in the amount of cases concerning Fosamax and DePuy hip replacements. For prescriptions starting this year, Fosamax will include a new label called a black box warning, updating the new information that has been uncovered about this drug. Fortunately, more patients will be aware of these side effects and will be able to take precautions to avoid injury. “Many products, either pharmaceutical or surgical are well intended but on occasion are not adequately investigated for potential side effects or effective functionality of the product. This is often done for financial or expedient considerations. When there are short cuts taken, people suffer,” says Mr. Migliore.

Concerns for Retired Fire Fighters

The Variable Supplement Fund (VSF) was established for retired Firefighters, Police, Transit and Housing officers in 1987. Officers who retire after 20 years of service are eligible to collect certain benefits under the legislation. The Variable Supplement Fund grants retirees pay and retirement benefit parity every year.

Mayor Bloomberg has announced his desire for discontinuation of the VSF for retirees. They would strip the $12,000 annual payouts from personnel and future retirees, which has been costing the city hundreds of millions a year. At a time when retirement costs are burdening tax payers, Bloomberg has continued to push Albany for broad pension cut-backs. It’s questionable whether current retirees could be denied the VSF because it is for past service, or at the very least, it is under attack. What is most concerning is the possibility that current retirees could lose more than the Variable Supplement Fund. There are calls to cut-back on retirees’ healthcare and Medicare part B coverage. This would significantly increase out of pocket medical expenses, as well as Medicare reimbursement.

There have been increasing calls for a Constitutional Convention at the New York State level. Currently, all retired fire fighters pensions are protected by a New York State constitutional guarantee. As the pension crisis mounts, many want to begin a Constitutional Convention where this pension guarantee could be removed. In addition, the well-deserved pensions of retired Firefighters have come under attack in the media with much blame being put on the pension system for the large state financial deficit.

Beware of Dangerous Prescription Drugs

Further investigation into Reglan has determined that patients, including infants and children, and the elderly, face significant risk of developing tardive dyskinesia. The risk is especially associated with those who have been on the drug for a long time, sometimes after a few dosages and even after the patient stopped taking the drug.

Fosamax – is used to treat and prevent osteoporosis in post-menopausal women, steroid-induced osteoporosis in men and other bone diseases. Investigation into Fosamax-related femur fractures determined that women and men who took the bisphosphonate drug face significant risk of a spontaneous femur fracture injury. These atypical hip/thigh fractures occur in minor or "low impact" falls from a standing height or less, as opposed to a traumatic accident or injury.

The FDA and other independent research studies indicate that femur fracture patients have reported experiencing severe pain of the joints, muscles and/or bones for periods of weeks to months before a complete fracture occurred.

The Pension Bailout and Retiree Benefits

Many labor unions are under extreme pressure due to trouble meeting it's pension liabilities. This problem specifically effects multi-employer pension plans in which union pension plans pay into a collective, large pension pool. Funds from these plans are sometimes diverted to other projects instead of actually funding the pension liabilities. As a result, the unions are struggling to come up with the money to pay the retiree's deserved benefits. Public pension and retirement plans across the nation, including plans at the municipal, state and federal levels, are facing the largest deficits in years. With the multi-employer pension plans, all pension-contributors are responsible for the pensions of the organizations that withdraw from the plan. With recent stock-market losses, the companies that are willing to pay a penalty to pull out are becoming more frequent and creating a system that has little money but a heavy load of obligations.

Senator Bob Casey of Pennsylvania has proposed a bailout for union pension plan holders, titled the Create Jobs and Save Benefits Act of 2010 (S 3157 IS). The act would shift the pension burden from the unions to the taxpayers via the Pension Benefit Guaranty Corporation. This federally backed corporation funds pension plans that become insolvent or cannot continue to pay out benefits. The corporation is already underfunded and burdened. Under the new act, if the pension plan actuary deems the plan to be heading for insolvency, the plan may be able to be moved to the Pension Benefit Guaranty Corporation. This would take the pension liability away from the union and put it in the hands of the government. After talking to Senator Casey's office, a representative indicated that the plan will, in fact apply to public union pensions, but the exact groups that would be eligible are still unknown as the Senator is still negotiating the matter.

While this bill would clear union balance sheets, there is serious concern about what would happen to a pension once its liability is shifted to the government corporation. The bill has a convoluted formula for benefit payouts after this happens, but a recent Wall Street Journal editorial (2010, August 16.The Next Pension Bailout, The Wall Street Journal, A14) suggests that even current retiree benefits could be limited to just $21,000 a year. This amount is hardly a livable sum of money, especially in light of current increases to the cost of living. While the bill title references “saving benefits”, retirees may actually experience the opposite. In fact, retirees could be greatly harmed if their plan is determined to be failing and is moved to the government, not to mention the added liability (as much as $165 Billion) that would burden the taxpayers.

There is no cause for alarm. One analysis contends that only 3 pension plans would be affected under the current proposed legislation. According to Mr. Casey's representative, it is still unclear which pensions will be eligible to be moved to the Pension Benefit Guaranty Corporation. New York government worker pensions are guaranteed by the New York State Constitution, for years there has been talk of calling a constitutional convention to remove that guarantee. There are no current calls for such a convention. However, if this guarantee is ever removed, New York State employees and their beneficiaries could lose their benefits or become subject to the same conditions under this new act. Many pensions funds across the nation are significantly underfunded due to stock market losses and increases in pension benefit payouts.

I would recommend talking to your pension fund provider to see if any new legislation is pertinent to your plan and to inquire about the financial solvency of the plan overall. Another important concern is health benefits. While New York State pension benefits are constitutionally protected, health benefits do not have that same level of protection. Health benefits often take cuts in times of economic hardship and it is important to watch the impact of any new legislation or health plan changes on your benefits. We are in an economic climate where retiree benefits have been negatively impacted at both the public and private levels. It is important to watch for potential changes to pension benefits and not take them for granted. It is critical to stay in front of these issues so that before any action is taken, we can recognize the signs and ensure that our legislators have heard from us before there is any reduction in benefits.

Our firm will continue to monitor the new legislation concerning pensions, as well as, the calls for a constitutional convention to change public pensions in New York State and will keep you informed of any changes. If any of these issues develop into a serious threat to your retirement and pension benefits, it may be necessary that we corporately make our voices heard. Editorial- Heroin on Long Island

The following editorial recently appeared in the Long Island Press, the Smithtown Times and the Independent:

Dear Editor:

The nightmare of heroin use on Long Island continues unabated, with at least one young person per week dying due to an overdose. Families, lives and dreams are being destroyed every day through the ongoing addiction. Horrifically, there seems to be a continuous flow of new users of this terrible drug.

Parents, entire families, teachers, law enforcement, prosecutors, probation officers, judges and defense attorneys alike are all exasperated with the issue. No one seems to be able to get it under control, putting innocent youths, as well as the safety of our homes, at immediate risk. Those that are already addicted have a relentless battle, possibly even a lifelong battle, to get free. Our best hope is to prevent these naïve young people from starting in the first place. This shall require a massive effort by parents, grandparents, aunts, uncles, older siblings, religious leaders, teachers, etc.—the entire community—to speak out against trying or experimenting with heroin.

It is a mistake to think that any family is safe, or that heroin use fits a particular stereotype. Please communicate with your families and be aware of this dire problem at hand. It is easy to get caught up saying or thinking: “Not me, not my family, not my grandson/nephew/sister.” However, the reality is that there are many parents and families, right here in our own communities, that have lost their child or a loved one to heroin and are wishing they had known better, or wishing they had done something to stop it.

I am writing this letter to tell you that you can do something: Reach out to them. Talk to them.

Communicate the severity and importance of this issue at hand. We must take every precautionary measure and step to ensure that those who have not tried it will not.

Dear Editor:

Now that Iran has thumbed their nose at the world over its progressive nuclear program, regardless of diplomacy or sanctions implemented, it seems the only language they will understand is hard economics.
It has been stated, both politically and economically, one step that needs to be taken in order to get the economy going, as well as halt Iran in its tracks, is to substitute foreign sources of energy with domestically produced energy. Here in the U.S., oil imports account for nearly half the trade deficit. The current administration must encourage drilling for oil and natural gas, here and now. Not only would this create countless jobs for a staggering economy with an unemployment rate over 10%, reduce our budget and trade deficits, but most importantly, it would crumble Iran; a nation fueled by an international, and overwhelming consumption of its prime resource: oil.
Now is the time for President Obama and Congress to open up every form of domestic oil and natural gas production. In doing so, the futures market will quickly react to the influx of supply, causing prices to drastically decrease. The further prices drop, particularly as production hits the market, the more Iran's economy will falter. Eventually, this will bring the leadership of Iran to their knees. This would be a far better alternative than the ongoing, and escalating danger of war.

Raptivs (psoriasis medication) injections information

Raptiva injections (a psoriasis medication)

Raptiva is a medication used to treat psoriasis, a chronic, non-contagious autoimmune disease which affects the skin and joints. Some individuals may have contracted PML, which is a rare, serious and progressive neurological disease caused by a virus that affects the central nervous system, after receiving Raptiva injections.

In February of 2009, a public health advisory was introduced concerning Raptiva after three confirmed, and one possible, report of PML emerged among patients using the drug. Three of those patients died and all four patients had been using the drug for more than 3 years. None of the patients had been receiving any other treatments that would suppress the immune system.When PML does occur, it is usually found in people whose immune systems have been considerably weakened and often results in a permanent weakening in neurologic function and death. There is no known effective treatment for PML.

We here at Migliore & Infranco, P.C. have recently taken on a potentially new defective hip replacement case, once again proving that these faulty medical devices are continuing to pose a threat to the public at large, especially senior citizens.

In this specific case at hand, the client underwent a routine hip replacement surgery in which a Zimmer medical device was implanted. After surgery, and less than one year later, the client states that his left leg did not operate properly and experiences severe pain when walking long distances. He also experiences a dislocating, popping sensation when bending over, as if the hip were coming out of the socket.
