Asbestos Exposure and Naval Veterans

Breathing asbestos has been associated with a multitude of medical ailments, including lung cancer and mesothelioma (a cancer of the lung lining). This is of particular concern for Navy Veterans, as asbestos was used as a source of insulation around valves and steam pipes, creating exposure to hundreds of thousands of Navy Veterans.

Those exposed to asbestos in the 1960s or 1970s may now begin to experience symptoms of asbestosis, lung disease, lung cancer or mesothelioma. These symptoms typically take roughly 10 to 40 years to develop symptoms after exposure. Due of the delay in symptoms, unfortunately, this disease is most frequently undetected until advanced disease is established.

Asbestos litigation continues to evolve as different companies are held responsible for asbestos- related disease and deaths. For example, in 2011, Leslie Control, Inc. created a trust for Navy Veterans as part of a pre-negotiated reorganization overseen by the U.S. Bankruptcy Court. A federal Bankruptcy judge for the District of Delaware affirmed the plan to reorganize the funding of the asbestos trust in an effort to resolve asbestos claims. Leslie Controls, Inc. is a manufacturer that supplied the U.S. Navy with equipment containing asbestos during the 1940s through 1980s. The fund was created to compensate U.S. Navy Veterans who have been harmed by breathing in asbestos.

Asbestos claims are still alive and growing

Recently, several insurance companies surprised investors when they announced increased reserve amounts for asbestos claims. Other insurance companies had decreased profits because of asbestos costs . Insurance giant, AIG, took a staggering $1.3 Billion in reserves for asbestos due to an industry wide trend towards expanding coverage theory for liability. This is also because there has been a higher frequency of mesothelioma claims in the past year and many have also been more severe cases. Insurance companies have had significant exposure to personal injury claims arising from asbestos and it looks as if asbestos claims will continue to increase. Asbestos takes years to manifest itself and for the effects of the exposure to appear. Many baby boomers are first realizing that they may have been exposed to asbestos and could develop a dangerous asbestos-related disease like mesothelioma. There are likely to be many more cases in the future from asbestos exposure that occurred during the Vietnam era and involving veterans of Vietnam.

While some asbestos manufactures have filed bankruptcy, many are still fully viable financially. The claims made to the manufacturers who are now bankrupt are handled by the bankruptcy trustees. Victims of asbestos are able to bring lawsuits because they have suffered because of a product whose dangers were initially concealed by manufacturers. The asbestos manufacturers knew that this product would have devastating effects but made no warnings to consumers or purchasers. The courts have recognized their liability, making it possible for victims to recover compensation for their injuries, pain and suffering. These recent developments show that there are potentially many more victims of asbestos and mesothelioma who can file a lawsuit.

With over three decades of experience, the law firm of Rudolph F.X. Migliore, P.C. is well equipped to help those suffering from Asbestos or Mesothelioma. The Long-Term Effects of Asbestos Exposure

Asbestos exposure can lead to a number of deadly diseases and harmful conditions. Victims of asbestos exposure may experience asbestosis, a respiratory disease that leads to scar tissue forming in the lungs. The scar tissue prevents the lungs from freely exchanging gases and expanding and contracting properly. A doctor can make make a diagnosis of asbestos after running a series of test and consulting with a B-reader. A B-reader is a specially trained doctor who can read chest x-rays and make a determination of asbestosis.

Beyond asbestosis, exposure to asbestos can cause several other major diseases, including some rare forms not traditionally associated with asbestos. For instance, peritoneal mesothelioma is an asbestos-derived cancer that appears in the abdomen. Other patients may be diagnosed with pleural thickening where the asbestos scarring is spread out and defused throughout the lining of the lungs.

Mesothelioma is a lung cancer that is caused only by exposure to asbestos. It is a highly aggressive disease that is usually the result of prolonged exposure, and while there are ever-expanding treatment options, there is currently no cure.

Asbestos leaves behind a specific trail that can be conclusively linked to many types of asbestos exposure, pleural thickening and mesothelioma. This makes the manufacturers of asbestos products directly responsible for the destruction and suffering this product has caused. The courts have recognized this, making it possible for victims, and the families of victims, to recover compensation for their suffering.

Asbestos at Madison Square Garden!

Asbestos Concerns at Madison Square Garden
Dangers Lurk Throughout NYC

In a city like metropolitan New York, there are many old buildings that were constructed or remodeled when asbestos was commonly used as insulation for pipes, in heating systems, in floor and ceiling tiles and for other purposes.
A Madison Square Garden announcement earlier this week is a reminder that at-risk buildings are everywhere in NYC. Even the world’s most famous arena is not immune.
Asbestos Debris Cancels Knicks Game
Madison Square Garden reported, “During overnight maintenance of Madison Square Garden, which included cleaning asbestos-related materials in the attic above the ceiling, some debris fell into the Arena.”
Out of an abundance of caution, and after consulting with the NBA, we are postponing tonight’s Knicks v. Magic game. We will be working with the city and independent experts, ATC Associates and GCI Environmental Advisory, to evaluate and determine the most appropriate course of action. As the safety of our customers and employees are our top priority, we will not reopen the Garden until we are absolutely assured the Arena is safe.”

Asbestos Victims Surface Decades Later
Since the 1930’s and 1940’s unsuspecting workers in many occupations used products made of asbestos. As workers inhaled asbestos fibers, the particles scarred lungs and in some cases, eventually caused a form of lung cancer, known as mesothelioma.
Make no mistake —Asbestos is Dangerous
Although doctors use radiation and chemotherapy to treat mesothelioma, there is no cure. If you or a loved one is fighting a battle with mesothelioma, you will have enormous medical expenses and have a right to hold liable parties responsible.

Rudolph F.X. Migliore, P.C. and our associates have a proven track record of recovering compensation for clients with asbestos related diseases, including asbestosis and mesothelioma.
